Dispute resolution in the international energy sector

Research Paper (postgraduate) from the year 2017 in the subject Energy Sciences, , language: English, abstract: The aim of the work is to show the variety of disputes in the international energy sphere and the ways to resolve them. The author is going to focus on the upsides and downfalls of the resolution tools and also on the alternative dispute resolution mechanisms. Besides, the author is going to provide a set of examples of the disputes already resolved and those that are still under resolution today. In order to achieve the stated purpose the following should be answered in this work: What types of disputes based on the parties exist? Whether the existing ways of dispute resolution are effective enough? What types of resolution is it better to resort to in various situations involving different kinds of parties to a dispute?Energy plays significant role in international community life and in international economic cooperation. The international energy industry has much more complex high-value disputes than other business sectors do and involve strong public interest, thus, it is crucial to explore efficient means of conflict prevention and dispute resolution. The thesis will cover the kinds of disputes rising in the oil and gas business, the types of dispute resolution mechanisms and instruments and legal framework for resolving those disputes. Special emphasis is placed on the alternative dispute resolution methods which are believed to be more cost-effective than litigation.
